Terrible new firearm process for 18-21 olds

Intro

When the Bipartisan Safer Communities Act (BSCA) of 2022 went into effect in November 14, 2022 changes were made to the firearm background check process for those between 18 and 21 years of age. Under the BSCA, when a person in this age group purchases a firearm, their background will no longer get the initial proceed, but an automatic delay. This delay can take an additional 10 business days after the standard 3 day delay passed. This leads to nearly 14 days between the day the check starts and we have a decision. We are unable to release the firearm until we get a proceed from NICS.

While it says they the FBI should be able to complete the process in the original 3 day period without needing extra time, in practice this has not been the case. During the enhanced background check, juvenile records are being opened and searched as well. The process will move faster for areas with all electronic records which will make searching easier. However, any location with paper records will see longer times. With any luck this section of the BSCA will be overturned and those in this age group can continue to enjoy their 2nd Amendment .

Firearm Restrictions

Currently no change was made to restricting 18-21 year old buyers from purchasing long guns.  The handgun restriction is still 21 and older, so no one under 18 still cannot purchase handguns.  They still are allowed to buy any rifle or shotgun except short barrel rifles and short barrel shotguns.  For any NFA items, you still must be 21 years old.

Ammo Restrictions

Nothing has changed in the restrictions of 18 year old persons buying ammunition. People under 21 are still prohibited from buying any handgun ammunition at this time. Accessory Restrictions

As it stands, there are no restrictions on people under 21 buying firearm accessories. We are very thankful for this. For those who do not know, Tannerite is a brand of reactive targets. They react to the impact of your shot. Do not use these items in areas where a fire could start. Would hate to explain to the fire department that your firearm shooting fun turned into a brush fire.

Conclusion and Call to Action

In short, the BSCA has limited the ability of those aged 18-21 to purchase a firearm. The extended period for the background check has been pushed out as many as 13 days on your delayed status. We get the final date after the initial 3 day wait period for a delay. I am sure some have come back within the normal 3 day delay period and the default Brady date works. However, it has been my experience lately that those under 21 have been required to wait the full 13 days. The first day is the next day after the background is submitted so in reality it is a 14 day waiting period to take home your firearm.
